Cloudtti Terms and Conditions of Service

Cloudtti.com grants you a non-exclusive, non-transferable, revocable license to use the web design, digital marketing, social media marketing and other products sold through our website by Cloudtti.com (Nictes LLC) in accordance with these Terms and Conditions issued by Nictes LLC.

Order

Customers agree to pay in full for all work designed and/or produced by Cloudtti.com for which they have placed an order. Cloudtti.com requires that 50% of the order total be paid in advance, in the form of one of the following: credit cards, checks, money orders, or cashiers check prior to beginning work on a design project. This deposit is non-refundable once the work has started. The remaining balance of 50% must be paid in full after completion of designs and design approval before the site goes live.

After 30 calendar days of the initial payment of 50%, the remaining 50% must be paid. All payments will be made in US dollars. Cloudtti.com does everything possible to ensure that the Client is 100% satisfied with each design and makes “reasonable” changes according to the first design shown to the client, until the end. Near or after completion of Customer’s ordered designs, opportunity will be given to view all or part of design(s) for adjustment, corrections and/or approval.

In Cloudtti.com’s attempt to transfer Clients’ visions into real, functional designs, minor tweaks or adjustments to completed work are sometimes required, and Cloudtti.com will certainly give Client the opportunity for review and/or approval as stated above, however it is not within ‘reason’ to request an indefinite number of changes. The texts, images, code or functionalities are requested and sent by the client in the initial period, for which any change in images, texts, videos or functionalities are not included in the initial agreement of the project and generate additional costs, as well as delays in the stipulated delivery times, since the client at the beginning of the project undertakes to deliver all the final content, texts, images, videos, structure and required functionalities and therefore Cloudtti.com will not work on a design again. an unreasonable number of times for the price of doing it once.

AFTER FINAL APPROVAL BASED ON THE INITIAL SUBMITTED CONTENT, PAYMENT MUST BE MADE AND THE COMPLETED PROJECT WILL BE DELIVERED, the order is considered placed and all new requests are considered new project orders.

Finish date

Cloudtti.com and Client must work together to complete the Web Design Project in a timely manner. We agree to work expeditiously to complete the Web Design Project after Client has submitted all necessary materials. If the Client does not provide Cloudtti.com with full text, graphics and other content necessary for this Web Design Project within 20 days after the effective date of this agreement, Cloudtti.com will retain the full amount of the deposit as liquidated. And the agreement will be null and void, at the option of Cloudtti.com, unless the Web Design Project is canceled in writing by the Client before 20 days of the effective date of the agreement.

Project delivery

The final website design project will be posted on the Client’s hosting service upon receipt of final payment. Hosting services require a separate contract with the hosting service chosen by the Client, either another provider or us. The Client agrees to select a hosting service that allows Cloudtti.com full access to the Client’s account via FTP (File Transfer Protocol), cPanel, SSH or other access credentials necessary to publish the project. The Client will be solely responsible for all charges for the hosting service.

Web Design Project Copyright

The copyright of the final design website produced by Cloudtti.com will be owned by the client once the payment has been made in full. Rights to photos, graphics, source code, review files, and computer programs specifically do not transfer to Client and remain the property of their respective owners. Cloudtti.com and its subcontractors reserve the right to display graphics and other web design elements as examples of their work in their respective portfolios. All web design projects will contain a link to the Cloudtti.com services website.

Refund policy

Since Cloudtti.com (Nictes LLC) is offering non-tangible products, we do not issue refunds once the services are purchased, which you are responsible for understanding when registering on our site.

Legal warning

Notwithstanding anything to the contrary contained in this Agreement, neither Cloudtti.com nor any of its employees or agents warrant that the functions contained in the Web Design Project will be uninterrupted or error free. The entire risk as to the quality and performance of the Web Design Project is with the Client. In no case will Cloudtti.com be liable to the Client or any third party for damages, including, but not limited to, service interruptions caused by Acts of Force Majeure, the Hosting Service or any other circumstance beyond our reasonable control, any loss profits, lost savings or other incidental, consequential, punitive or special damages arising out of the operation or inability to operate this Web Design Project, failure of any service provider, of any telecommunications provider, of the Internet backbone , of any Internet server, the customer’s visitor’s computer or Internet software, even if Cloudtti.com has been advised of the possibility of such damages.

The Agreement

The original agreement constitutes the only agreement between Cloudtti.com and the Client with respect to its Web Design Project, Digital Marketing Campaigns, Social Media Marketing Campaigns and SEO Services. Any additional work not specified in the original agreement or any other amendment or modification to this agreement must be authorized by written request acknowledged by both Client and Cloudtti.com (NICTES LLC).

Others

Any legal action due to the violation of this contract and / or copyright violations will result in financial costs, fines, court costs and miscellaneous expenses, and will be the sole responsibility of the client as established by the laws of the United States. The client releases Cloudtti.com from any and all legal actions or monetary settlements arising from the violation of this contract. Cloudtti.com will show all the work done on this site for the means of advertising services and, however, similar to the promotion of your company, unless the client specifically indicates otherwise in writing. Customer paid a deposit and/or signed or electronically signed signature means the agreement is binding.

Changes to our Terms and Conditions

We reserve the right to modify or revise our Terms and Conditions at any time. Revised information will be posted on this page.
